Welcome to LazyOtter.finance ("we," "us," or "our"), the website developed by LazyOtter Limited BVI for accessing the LazyOtter Protocol (the "Protocol" or "LazyOtter Protocol"). LazyOtter.finance serves as a gateway to the decentralized finance (DeFi) services provided by the LazyOtter Protocol, offering users a platform to engage with our innovative financial ecosystem more safely with informed decision-making based on risk information.


Acceptance of Terms

These Terms and Conditions, along with any documents they expressly incorporate by reference (collectively, the "Terms"), govern your access to and use of LazyOtter.finance ("the Site") and any related services (collectively, "the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.


Use of the Service

The LazyOtter Protocol provides a non-custodial, decentralized financial service platform. We do not have custody or control over the assets you trade or hold within the Protocol; nor do we have access to your private keys. You retain full control over your assets at all times.


User Representations

By using the Service, you represent and warrant that:

  • You are of legal age and have the legal capacity to enter into these Terms.
  • You are not a U.S. Person;
  • You are not a resident, national, or agent of any country to which the United States, the United Kingdom, or the European Union embargoes goods or imposes similar sanctions (collectively, "Restricted Territories"), included but not limited to the followings:
    • Cuba
    • Democratic People’s Republic of Korea (North Korea)
    • Iran
    • Syria
    • Venezuela
  • You are not subject to economic or trade sanctions administered or enforced by any governmental authority; or otherwise, you are not a member of any sanctions list or equivalent maintained by the United States government, the United Kingdom government, the European Union, or the United Nations, including without limitation the U.S. Office of Foreign Asset Control Specifically Designated Nationals and Blocked Person List (collectively, "Sanctions Lists Persons"); 1.1.6. Risk

You acknowledge and agree that engaging in DeFi activities involves significant risks. We are not responsible for any losses you may incur as a result of using the LazyOtter Protocol.


Fees

You are responsible for all transaction fees associated with using the LazyOtter Protocol, including but not limited to gas fees and protocol-specific fees.


Proprietary Rights

You acknowledge that we own all rights, titles, and interests in and to the Service, excluding any rights expressly granted to you. You agree not to engage in any activity that would infringe upon our rights or the rights of others using the Service.


Modification and Termination

We reserve the right to modify, suspend, or terminate the Service or your access to it at any time, without notice, for any reason, including for breach of these Terms.


Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.


Limitation of Liability

We will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.


Indemnification

You agree to indemnify and hold harmless LazyOtter Limited BVI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service.


Dispute Resolution

Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the British Virgin Islands.


Governing Law

These Terms will be governed by and construed in accordance with the laws of the British Virgin Islands, without giving effect to any choice or conflict of law provision or rule.


Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the Service.
